The repeal of PASPA essentially made it no longer a federal offence (this was great for existing black market operators, tbf) and left it to the States to regulate - some did, with varying degrees of competence, most did not, and that left the window open.

Prohibition created the environment, lack of regulation poured fuel on the fire.
